We currently hold so-called live auctions, with the option to place advance bids until the auction starts at 12:00. Please note that this is not the same as a timed online auction! At 12:00 bidding continues on the website, in real time. Read more about how a live auction works here >
All items are sold as is. We give our customers the opportunity to inspect the items themselves during the viewing. Photographs and information about the items online are for your guidance as a buyer only. The photographs are not intended to show defects or damage. Buyers must inspect the items on site themselves or contact us for a more detailed description. Please note that it remains your responsibility if you choose to bid on an item you have not inspected.
A bid you have placed in an auction is binding. You cannot change your mind and withdraw a bid. It is therefore important to think carefully before you bid, so that you are sure you want to buy the item at that price.
Payment for an item you have won must reach us within the invoice's payment period. Items must be paid for before they are collected or shipped, or paid for here at the auction house when you collect them. This means that even if the invoice's due date is later than the day you collect the item(s), payment must be made on collection. In case of non-payment we work with Profina Inkasso, in which case an administration fee of SEK 500 is charged. If the invoice exceeds SEK 1,000, a further 10% is added on top of the SEK 500.
Items must be collected within 10 days (calendar days) of the auction. After these 10 days, a storage fee of SEK 40 per day is charged. The same applies to packed goods where shipping has been ordered but the shipping invoice has not been paid within 10 days.
If you would like your items shipped, let us know as soon as possible after the auction ends, preferably by e-mail. The shipping cost is charged on a separate shipping invoice. For the goods to be shipped on the Thursday after the auction, payment for won lots and the shipping cost must reach us no later than Thursday at 10:00 after the auction. If payment has not arrived by then, the shipment will go out the following Thursday, with the next DHL collection. All shipments are sent by DHL only, on our fixed collection day: Thursdays. Parcels that are not collected and are returned to us can be picked up here or re-sent at a new shipping cost.
Items not collected or shipped within 10 days of the auction: Östersunds Auktionsverk reserves the right to cancel the purchase if the buyer fails to collect the item or to pay the invoice/shipping invoice.
If you pay but do not collect the item within ten (10) days of the auction, Östersunds Auktionsverk will send you a reminder asking you to collect it, failing which the purchase may be cancelled twenty-eight (28) days after the end of the auction. If the purchase is cancelled, you as the buyer are entitled to a refund of what you have paid to Östersunds Auktionsverk, less the storage fee above.
If you as the buyer do not collect the item within three (3) months of being asked to, Östersunds Auktionsverk also reserves the right to sell the item in accordance with the Swedish Act on Traders' Right to Sell Uncollected Goods (1985:982) (Finland 1988/688).
The proceeds of such a sale go first towards the costs of the sale and the storage fee, and then towards any amounts the buyer owes Östersunds Auktionsverk that have fallen due. Any surplus is paid to the buyer.
The right of withdrawal applies to live auctions online, where you take part remotely, but not to traditional auctions where you can attend in person at the auction premises. If you win the bidding at a traditional auction you attend in person, you have no statutory right of withdrawal. You must then complete the purchase and cannot demand to return the item and get your money back.
When you buy something away from a company's business premises, the price you pay must exceed SEK 400 excluding fees for you to have a right of withdrawal. If the amount is lower, you have no right of withdrawal.
If you have won the bidding at a live auction online, you have a right of withdrawal under the Swedish Distance and Off-Premises Contracts Act. The right of withdrawal applies for fourteen (14) days from the day after you received the item.
If you wish to exercise your right of withdrawal for a purchase, you must notify us within the withdrawal period of fourteen (14) days from the day on which you, or your representative, take possession of the purchased item.
Notice of withdrawal must state the item's lot number and your customer number, and be sent to Östersunds Auktionsverk by e-mail to info@ostersundsauktionsverk.net. You must use the same e-mail address that is registered on your customer number.
After withdrawing from the purchase, you must return the item to Östersunds Auktionsverk at your own expense within fourteen (14) days. The return must be made promptly and without delay, and may not be sent cash on delivery. As the buyer, you bear the risk of the item being damaged or lost, and you must pack and handle it so that it is not damaged in transit.
If the item has not been returned within fourteen (14) days of your notifying Östersunds Auktionsverk that you are exercising your right of withdrawal, and you have thus not fulfilled your obligations under the law, you remain bound by the purchase and no refund will be made.
Once Östersunds Auktionsverk has received the item, the amount you paid is refunded within fourteen (14) days, less any reduction in the item's value caused by your handling it more than necessary.
A buyer may not bid again on an item for which they have exercised the right of withdrawal.
If Östersunds Auktionsverk considers that a buyer is abusing the right of withdrawal – for example by using it to get out of bids they have placed and thereby affecting the bidding process, the seller or other customers in a way that is unacceptable to Östersunds Auktionsverk – Östersunds Auktionsverk reserves the right to close the buyer's account and thereby the buyer's access to the Service.
Under the EU General Data Protection Regulation (GDPR), in force since May 2018, all customers must consent to their personal identity number and address details being stored in our customer register. The GDPR replaced the previous Swedish Personal Data Act (PUL). This applies to both new and existing customer numbers.
Artist's resale right / Droit de suite: Under the Swedish and Finnish copyright acts (Sweden 1960:729, Finland 404:1961) and EU Directive 2001/84/EC, a resale royalty is payable on the resale of works of art and applied art. The resale right is a copyright royalty paid to the artist during their lifetime and then to their heirs for 70 years after the year of the artist's death. The royalty is calculated as a percentage of the winning bid, and the percentage varies with the sale price. Where an item sold through the Service is subject to this royalty, this is stated in the item description and the royalty is payable by the buyer.
